Further tightening of investment control in Germany is to be expected – BMWi presents new ministerial draft bill
Commercial Courts, Chamber for International Commercial Disputes and newly opened International Arbitration Center – Germany catches up with its international competitors in dispute resolution as London, Paris, Zurich and Singapore.
November 17, 2020 the opening of the “Hamburg international Arbitration Center (HIAC) will be celebrated. A new platform and organization offering German and foreign clients to resolve their conflicts with domestic and international business partners, www.dispute-resolution-hamburg.com
From November 2, 2020 two Commercial Courts in Stuttgart and Mannheim are open to serve the international legal community in Germany. Since January 1, 2018 already disputing parties can choose to have their disputes resolved in English language by the Chamber for International Commercial Disputes at the Landgericht Frankfurt am Main.
All these projects are the result of the Law made in Germany-Initiative of the Germany Commercial Chamber of Commerce and joint federal- and state government legislation supplemented by the many programs of the DeutscheAnwaltsverein – ARGE International Business Law, www.dav-iwr.de.
What’s the verdict with the English language courts and arbitration center?
The German legal system isn’t always the easiest for Germans to follow, and in particular difficult if parties are from aboard with limited knowledge of the German language. The hope is that the new projects will enhance the country’s reputation for settling international business disputes and catch up with other dispute resolution centers which have set up similar platforms in recent years.
